Terms and Conditions

For the application of the present General Sales Conditions, it is agreed that the User and JustMyLamp will be collectively referred to as the “Parties” and individually referred to as the “Party” and that the User having validated an order will then be referred to as the “Buyer”. The rights and obligations of the User necessarily apply to the Buyer.

The User who wishes to purchase on the site declares that he/she is over 18 years of age and has full legal capacity or has the authorisation of a person with parental authority, a guardian or a curator.

Any order of a Product offered on the site implies the consultation and express acceptance of these General Terms and Conditions of Sale, without this acceptance being conditional on a handwritten signature by the User.

The present General Conditions of Sale apply, without restriction or reserve, to all sales concluded by JustMyLamp with non-professional buyers, wishing to acquire the products offered for sale by the Seller on its websites mentioned above.

These General Terms and Conditions of Sale are accessible at any time on these websites and will prevail, if necessary, over any other version or any other contradictory document.

In the absence of proof to the contrary, the data recorded by JustMyLamp constitutes the proof of all transactions. In accordance with the legal provisions, it is reminded that the validation of an order is carried out by clicking on the “BUY” button. This validation constitutes an electronic signature which has the same value between the parties as a handwritten signature and is proof of the completeness of the order and the payability of the sums due in execution of said order. In all cases, the online provision of the credit card number and the final validation of the order will be considered as proof of the completeness of the said order in accordance with the provisions of the law of 13 March 2000 and will be considered as proof of the sums due by the seizure of the articles appearing on the order form.

Access to the JustMyLamp site is made under normal Internet connection conditions. No additional connection cost will be charged to the User. These General Terms and Conditions of Sale may be subject to change, the conditions applicable are those in force at the date of placing your order. The editing and saving of these conditions are the responsibility of the Buyer.

The purpose of these General Terms and Conditions of Sale is to define, exclusively for the relations that the Parties establish on the Internet, their respective rights and obligations arising from the online sale of the products offered on the site. These conditions regulate all the steps necessary for the placing of the order and ensure the follow-up of this order between the Contracting Parties. The Parties agree that their relations will be governed exclusively by this contract. If a condition is missing, it will be considered to be governed by the practices in force in the distance selling sector whose companies are based in ES.

The prices are indicated in euros, taking into account any discounts and the VAT applicable on the day of the order. The prices indicated are guaranteed within the limits of available stocks, except in the event of significant changes in charges, including VAT, and except in the event of typographical errors or omissions. The prices indicated do not take into account the delivery costs which will be invoiced in addition and will be specified to the User during the final validation of his order.

JustMyLamp reserves the right to modify its prices at any time but the Products will be invoiced on the basis of the prices in force at the time the order is registered, subject to the availability of the said Products. If an order is validated and contains one or more erroneous elements (price, description, photo, coupon, etc.), Justmylamp reserves the right to cancel the order and to reimburse the customer.

The observed selling price indicated “crossed out” in the description of each item is given purely as an indication, for comparison purposes, and corresponds to an estimate by the supplier of JustMyLamp of the average selling price of the item in its traditional distribution network on the date of marketing.

The User can view the various Products offered for sale by JustMyLamp on its site. The User can freely browse the different pages of the site, without being committed to an order.

Registration is necessary and mandatory to place an order. The User must accurately fill in the information requested and required on the “My Account” page and on the sub-pages of the “My Information” section. In particular, he/she shall include the information necessary for his/her identification and, in particular, his/her first and last names, postal address, e-mail and password.

JustMyLamp guarantees the confidentiality of the data transmitted after the said password has been entered. The User is responsible for the use of his password. He/she is responsible for its conservation and confidentiality. In case of loss of the said password, the User must contact JustMyLamp as soon as possible so that a new password can be given to him.

In case of forgotten password, the User can obtain a new one by clicking on the link “Forgotten password” displayed on the home page. A form for creating a new password will be sent to him by e-mail. When creating his account, the User can authorize JustMyLamp to send him by e-mail, among other things, invitations to sales as well as press releases from the JustMyLamp Team.

The User places his order via an Internet connection enabling him to browse the site. In order to be accepted, the order must contain all the useful and necessary information for its processing. Furthermore, any order implies acceptance of the General Terms and Conditions of Sale, the prices and description of the products available for sale.

If the User wishes to place an order, he/she shall select the various products that interest him/her and express his/her interest by clicking on the “Add to basket” box.

At any time, the User may:

Obtain a summary of the Products they have selected, by clicking on “My basket”.
Continue their selection of Products by clicking on “Continue shopping
Complete their selection of Products and order the Products by clicking on “Buy”.
In order to order the Products selected in his basket, the User must identify himself, either by entering his e-mail address and password if he has already created an account with JustMyLamp, or by filling in the “Register” form if he has not. The User is informed and accepts that entering these two identifiers to access his customer account (email address and password) confirms his consent.
Once the User is identified, he/she must validate the delivery address and an order summary will appear on the screen, specifying: the nature, quantity and price of the Product(s) selected by the User, as well as the amount of the delivery costs, the total of the order, the User’s contact details and the delivery address.
After having read the details of the future order, and once all the information requested has been completed by the User, the latter may click on “Pay the order” to definitively confirm the order.

In the case of payment by credit card, the User must provide certain information relating to the credit card used:

The name of the credit card holder,
The credit card number,
The expiry date of the card,
Its cryptogram number (3-digit number on the back of the bank card).
It is specified that with an immediate payment by credit card or bank transfer, means of payment proposed by JustMyLamp on its website, the User will make his payment via the JustMyLamp website using the Eftpos system (Electronic Payment Terminal). The JustMyLamp website is secured by S.S.L. (Secure Socket Layer) encryption in order to protect all data linked to payment methods as effectively as possible. Thus, the User’s banking data are transmitted to the bank, which is itself secured by S.S.L. encryption, and at no time will the User’s banking data be transmitted on JustMyLamp’s computer system. JustMyLamp is therefore not responsible for this.

The User can save his bank details so that he does not have to enter them each time he orders. As soon as he validates his payment by credit card or bank transfer, the order is recorded and becomes irrevocable. The User becomes a Buyer. The order form will be recorded on JustMyLamp’s computer registers, which are themselves kept on a reliable and durable medium, and will be considered as proof of the contractual relations between the Parties.

Once the Buyer has validated his/her payment by credit card (with the provision of his/her card number, expiry date and cryptogram) or bank transfer, a summary of the Buyer’s order will be sent by e-mail, upon receipt of the order form, to the e-mail address indicated by the Buyer at the time of the order. This confirmation will include all the elements constituting the contract between the Parties, as well as an estimate of the date of shipment.

JustMyLamp recommends that the Buyer keeps the order confirmation email or prints it. However, the documents archived in the computer systems of JustMyLamp will be considered as legal proof. A summary of the order will also be displayed in the customer account.

In the event that you refuse delivery of your order to your door, our general terms and conditions of sale will apply and the delivery costs and return costs will be deducted from a potential refund request. If you decide to cancel your delivery once the goods have been dispatched from the warehouse, the relevant costs will be deducted from any refund claim.

Coupons are materialized by a code that will be entered or has already been assigned to the customer account. A code may be sent by e-mail or post during special operations or the customer will be informed by e-mail of the allocation of a coupon in his customer account.

Only one coupon may be used on a single order. Under no circumstances may it be converted into currency. The coupons issued have an expiry date that cannot be changed. No new coupon may be issued or allocated to a User to replace an expired and unused coupon.

The application of a coupon necessarily implies that the value of the basket (before the calculation of shipping costs) is higher than the value of the coupon, except in the case where the particular conditions of use of the said coupon specify a minimum purchase amount (before the calculation of shipping costs). In this case, the value of the basket (before the calculation of shipping costs) must be higher than the value of the minimum purchase required to use the coupon.

A Buyer may not ask JustMyLamp to deduct from an order already validated and paid the value of a coupon whose code was not entered, selected or was defective when the order was placed.

In order to benefit from the discount associated with a coupon, the User will have to enter or select the coupon code which he will find in the drop-down menu of his basket, and provided for this purpose. After entering the coupon, the User must click on the “Ok” button. The discount will be immediately deducted from the amount of the order.

When an order contains a coupon, the amount of the coupon is distributed over all the items in the order in proportion to their respective value. The refund of a product in an order, for whatever reason, is made after deduction of the associated coupon.

The amount due by the Buyer is indicated before the validation of the order by the User and on the order confirmation sent by e-mail by JustMyLamp to the Buyer.

The payment will be made only on the Internet by credit card (Blue, Visa, Eurocard/Mastercard) and by bank transfer.

The order will be considered valid after confirmation of the bank payment agreement. In case of refusal by the bank, the order will be automatically cancelled. In any case, JustMyLamp reserves the right to refuse any order or any delivery in case of dispute with the Buyer, of non-payment or partial payment of a previous order by the Buyer, of refusal of authorization of payment by bank card by the banking organizations. JustMyLamp cannot be held responsible in case of dispute.

When the Buyer pays with an immediate debit card, the Buyer’s bank account is debited within 2 to 5 days following the placing of the order. This period varies according to the banking institutions.

In the case of a deferred debit card, the Buyer’s bank account will be debited for the amount of the order under the same conditions as the usual debits.

JustMyLamp has set up a verification procedure to prevent any fraudulent use of bank details to place an order on the Site. Within the framework of this verification, the customer may be asked to send JustMyLamp (by fax, by mail or by email) a copy of both sides of his identity card as well as a proof of residence of less than 3 months. The order can only be shipped after the verification of the documents sent has been received. JustMyLamp reserves the right to proceed with the reimbursement of the said order in case of non-receipt of the documents or in case of receipt of non-conforming documents.

Only customers who have placed an order for an amount greater than the amount defined by JustMyLamp will have to provide these supporting documents. Following the registration of their order, the Buyer concerned will receive an e-mail from the JustMyLamp Customer Service.

Upon receipt of your order from our warehouses, it is essential to check the condition and conformity of the products received.

If you have any complaints to make, please write on the receipt all the reservations and observations you consider useful, particularly concerning damage (specify if the packaging is damaged: torn protective film, damaged packaging, etc.), and refuse to accept the goods. Do not sign under pressure from the service provider. If he does not agree, specify the reason on the collection form: ‘the service provider did not wish to be present during the unpacking and inspection of the package’. This is your right and the only way to dispute any damage. The mention “subject to unpacking” has no legal value.

Any anomaly concerning the product (missing, broken, non-conforming product or damaged packaging) must be notified to JustMyLamp’s Customer Service Department at the following address within 24 hours of collection of the package: Contact. Any complaint made after this period will be rejected and JustMyLamp will be released from any liability.

If the Buyer has not been able to collect his parcel, it will be kept at JustMyLamp’s warehouse. JustMyLamp will then offer the Buyer to make the order available a second time in the United Kingdom and charge the cost of the second delivery.

This last procedure also applies to packages returned by your Carrier due to an incorrect delivery address or an unknown recipient.

If you are not satisfied with the items you receive, you have a period of fourteen (14) days from the date of receipt of your order to return them in their original condition suitable for resale.

In order to ensure a quick processing of your return, please insert the return email that will be sent to you by the Customer Service in your package. If you do not have a printer, please write down your order number, return authorization number and the codes of the products to be returned on a piece of paper.

JustMyLamp.com will reimburse you within a maximum of 72 working hours from the date of receipt by JustMyLamp.com of the parcel in its original condition. An email confirming the refund will then be sent to you. We will make the credit via the payment method you used when paying for your order.

When an order contains a coupon (or discount code), the amount of the coupon is distributed among all the items in the order in proportion to their respective values. The refund of a product in an order, for whatever reason, is made after deduction of the associated coupon.

If you have received a defective item or one that does not correspond to what you ordered, we are very sorry.

You have 24 working hours following receipt of your order to contact our Customer Service Department and inform us of the situation.

We recommend the following checks to see if your order is incomplete:

Ensure that your item has been ordered by checking your order confirmation email or by referring to your order details in the “My Account/My Orders” section.
Check the Delivery Note attached to your package. If the quantity shipped does not match the quantity ordered, the item may be:
shipped in another package that you will receive shortly
unavailable, the refund will be made within the next 72 hours
cancelled since you have requested it
Check again the reference of your missing item on your Delivery Note. If the quantity shipped does not correspond to the quantity ordered, please contact our Customer Service.

Upon delivery, the buyer or a third party designated by him/her will check the packages and products received. He will check the number of packages and products delivered, verify the condition of the packaging and inspect the products for any damage, defects or non-conformity.

In the event of a complaint, the buyer will have 24 hours (not including public holidays) to contact the transport company that made the delivery and inform them of the problem encountered.

If the claim is not admissible, the buyer shall detail precisely on the delivery note any damage, defect, shortage or non-conformity that he/she has noticed knowing that “subject to unpacking” has no value.

The buyer shall confirm his reservations by registered letter with acknowledgement of receipt to the customer service of JustMyLamp at the following address:

The purchaser will be able to justify any claim that he/she will have made and to allow JustMyLamp to have at its disposal the supporting documents that would be necessary to resolve this claim.

In the case of the acceptance of a complaint, JustMyLamp will proceed within 72 hours (working days) to the exchange of the product or to its reimbursement (via the payment method you used at the time of payment) if the reference of this product is no longer available.

The buyer shall hand over the product to the carrier designated by JustMyLamp, in its original condition and packaging, and with all its accessories if it includes any.

Following repeated abuse by customers, the company will no longer accept any “non-compliant product” returns that do not respect its conditions.

The personal information collected in the context of distance selling is compulsory, as this information is necessary for the registration, processing and delivery of orders as well as for the preparation of invoices. This information is strictly confidential. Failure to provide this information will result in automatic rejection of the order.

In accordance with the law n°78-17 of January 6, 1978 relating to data processing, files and freedoms, the processing of personal information collected on the Site has been declared to the Commission Nationale de l’Informatique et des Libertés (CNIL declaration).

The User has the right to access, modify, rectify and delete data concerning him/her. To exercise this right, the User must send a letter to the JustMyLamp Customer Service (address mentioned above). In any case, the User shall ensure that he/she reiterates his/her name, first name, address and, if applicable, his/her Buyer number.

Finally, JustMyLamp may communicate personal information to its commercial partners. The User may thus receive commercial offers from third parties. In this respect, it is specified that unless the User expressly refuses, his postal address may be communicated to JustMyLamp’s commercial partners. However, as far as his e-mail address is concerned, it can only be communicated to the said partners with the express agreement of the User. Of course, the User can refuse such communication, either by not giving his consent when registering and/or validating his order, or by expressing his refusal by post, in accordance with the paragraph above.

The only cookies that JustMyLamp creates are those of the session which will be deleted when the user disconnects from the site.

Some web pages of the Site may contain electronic images or “web beacons”, which allow to count the number of visitors of the page.

These web beacons may be used with some of our partners, in particular to measure and improve the effectiveness of certain advertisements. In any case, the information obtained via these tags is strictly anonymous and simply allows us to gather statistics on the number of visitors to certain pages of the Site, in order to better serve the Users of our Site.

For each item on sale on the Site, JustMyLamp undertakes to provide a description sheet to present its essential characteristics, within the limits of the information provided by the suppliers. JustMyLamp makes every effort to provide the User with as much information as possible to enable them to know the products before placing their orders.

Despite all the care taken in the drafting of these descriptions, an error may occur. If the User notices an inconsistency, he/she can contact the Customer Service to inform them.

JustMyLamp undertakes to correct these errors as quickly as possible. The photographs as well as the descriptions of the products are not contractual and JustMyLamp cannot be held responsible for any errors that may exist.

In particular, the images and colours of the products displayed on the site may not be exactly faithful to the real colours of the articles due to the effect of the Internet browser used and the resolution of the User’s screen (photos and descriptions are not contractual).

JustMyLamp sells first quality items. However, some items sold have “vintage” effects and have voluntary deteriorations intended by the manufacturer (holes, discolorations, whiskers, permanent folds…). These items have been treated to give them a special appearance. The details added to the fabric are often done by hand. It is therefore impossible to ensure the homogeneity of the articles. It is therefore normal to see differences between the item photographed and the item delivered.

The guarantees of the products sold are indicated on the description sheet. The Buyer who has a defective item, for which the guarantee is still applicable, must contact JustMyLamp’s Customer Service, which will inform him of the procedures to follow in order to obtain a repair, a replacement or a refund. Customer Service may ask the Buyer to contact the supplier directly. JustMyLamp will do its best to provide the Purchaser with the contact details of the supplier’s After Sales Service.

The guarantees of the sold products are written on the description sheet. The Buyer who has a defective item, for which the warranty is still applicable, must contact the JustMyLamp Customer Service who will inform him of the procedures to follow in order to obtain a repair, a replacement or a refund. Customer Service may ask the Buyer to contact the supplier directly. JustMyLamp will do its best to provide the Purchaser with the supplier’s after-sales service contact details.

JustMyLamp’s liability is limited to the amount of the Buyer’s order. JustMyLamp cannot be held responsible for any inconvenience or damage inherent to the use of a computer, a computer network or the Internet. In particular, JustMyLamp cannot be held responsible for a break in service, an external intrusion or the presence of a computer virus. JustMyLamp has only an obligation of means for all the stages of access to the site, in particular the consultation, the filling in of forms, the placing of orders, the payment as well as any other service available on the JustMyLamp site.

JustMyLamp cannot be held responsible for any material, immaterial or physical damage caused by the malfunction or misuse of an item purchased on the Site.

It is the User’s responsibility to check with the local authorities for specificities regarding taxes, declarations, prohibitions, possibilities of importing or using the products ordered. JustMyLamp shall not be held responsible in case of non-compliance with the legislation of the country where the products are delivered.

In the event that one of the clauses of the present contract should be null and void due to a change in legislation, regulations or a court decision, this shall not affect the validity of and compliance with the present general conditions of sale.

All the elements of the Site, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents. They are the exclusive property of JustMyLamp. The user who has a personal website and who wishes to place, for personal use, on his site a simple link referring directly to the home page of the Site, must request authorization from JustMyLamp. On the other hand, any hypertext link to the Site using the framing or in-line linking technique is strictly forbidden. In any case, any link, even tacitly authorised, must be removed on simple request from JustMyLamp. Hypertext links may lead to sites other than the Site. ClickLamp disclaims all responsibility in the event that the content of these sites contravenes the laws and regulations in force.

These general terms and conditions of sale and the order summary sent to the Purchaser form a contractual whole and constitute the entire contractual relationship between the Parties.

These terms and conditions apply for the entire duration of the Products offered by JustMyLamp.

JustMyLamp shall not be held liable for the total or partial non-performance of its obligations under this contract, if such non-performance is caused by an event constituting force majeure, in particular in the event of disruption or total or partial strike, notably of the postal services and means of transport and/or communications, flooding, fire.

Events meeting the criteria set by the case law of the Cour de cassation shall be considered as force majeure. In the event of an event constituting force majeure, JustMyLamp shall notify the User/Purchaser within five (5) working days following the occurrence or threat of this event.

The Parties agree that they will have to consult each other as soon as possible in order to determine together the modalities of execution of the order during the duration of the force majeure event.

After a period of one (1) month of interruption due to force majeure, JustMyLamp may not honour the order, and will reimburse the Buyer if necessary.

In accordance with article 6.III.1° and 19 of the law n°2004-575 of 21 June 2004 for confidence in the digital economy, the following elements are specified to the Users of the Site:
